Wal-Mart's Sick Day Policy

We recently came across this blog post about Wal-Mart's sick day policy at the OSHA Underground Blog and thought it was interesting:

A reader from Walmart told us about her first day orientation....

She watched a video saying "Wal-Mart is the coolest, best place on earth and forget what everyone else says, they're just jealous."

"A sick day, any sick day short of hospitalization is considered an UN-authorized absence at Walmart"

Another video proclaimed "Wal-Mart is better because there are no unions and nobody joins a union anymore and union reps are stupid and how dare they try to recruit you and joining a union is stupid and only stupid people still belong to unions."

WE can imagine the panflu starting at Walmart due to the sick leave policy.

Actually, this statement is false. Perhaps those who inform this website about the "Facts" of Wal-Mart should be an employee, not someone who interprets what they hear from friends.

I lost my job at Wal-mart while on a FMLA leave for being sick. I have a permenet condtion called Epilepsy and lost my Prescrition coverage could not afford the new coverage Thanks SUSAN CHAMBERS FOR THAT ONE. Was forced to convert my Intermittent LOA to a Regualr LOA and upon returning was met at the time clock with the Green Sheet and fired even though I was on an APPROVED LOA.

Wal-mart should tell the truth and give us the real reason they are afraid of unions. They should say that the reason we don't want you to join a union is because we don't want to pay you a living wage and we don't want to provide you with affordable health care and other benefits that union members enjoy.
I have been a UFCW member for quite some time now and I consider my union rep to be my agent and my lawyer.
Athletes and movie stars hire agents to negotiate their pay. People hire lawyers to protect their rights. Why shouldn't a company employee hire an agent to look after their legal rights?

Just heard that all those people that work down south in the areas ravaged by TORNADOS THEIR ABSENCES ARE NOT EXCUSED.

Damon-------I was and repeat was and these facts are true. Are you?

If you don't like FMLA then talk to your senator. Don't blame wal-mart. If you miss the first day due to being in the hospital then it is unexcused, but what this fails to tell you is that if the person would have got a LOA and had a doctor sign it then it would have been excused. I am sick and tired of winey a.. people who don't want to work.

i AM an employee of walmart, and although i disagree with some of the company policies, and i get upset with the constant goings-on at my facility, i just want to say that it's silly to put those statements in quotations. when i hired in at walmart (granted, that was 6 years ago and maybe the training wasn't as catchy as it is now), there wasn't mention of anything being "coolest" or anyone being "just jealous" or "stupid". i'd like to see the video being described. if nothing else, it could be good for a laugh.

now about the absence policy, yes, just about any absence is unexcused these days. i don't agree with that either. i didn't agree with the policy before that stated we had to be sick for a minimum of 2 days before we could use sick pay, and we had to use personal time for the first day with sick pay to cover the following days. it's silly. if a person is sick, then they should be able to use sick days. especially if substantiated with a letter from a physician. unfortunately, like most walmart employees, i can't afford to run to the doctor every time i get a bug. so i end up working sick. which just spreads the illness as i lurch around coughing and sneezing on my coworkers. the fact is though, whether anyone wants to believe it or not, people take sick days for many reasons other than for being sick. sick days for shopping, for sleeping in, for an early or extended vacation. you name it. abuse of priveleges is the fastest way to lose them. it doesn't make me happy, and i'm not supporting the policies. i'm just saying that walmart has a certain level of C.Y.A. that they need to meet. once the weather gets nice and people want days off for no reason other than to go fishing, or hit the beach, walmart can't afford to have half of their staff call off "sick". so their policy is designed to minimize that. if a person is truly ill, walmart offers leave of absence packages that will (supposedly) prevent repercussions. i'd imagine that they don't work for everyone.. just like walmart isn't for everyone. for me, it's better than no job at all.

Well, let me tell you this, I am a Member of Management at Wal-Mart and I have to tell you it is true, if you miss a day of work because you are sick, that is an unexcused absence. If you have to stay home because you are sick when we do the attendance tracking and you have to stay home more than 2 or 3 days you loose one day of pay and then you get pay for the second day and even like that is not an excused absence. We have an 1800 Number to call when an associate is going to be absence but that number is just to let us know that you are going to be absence or tardy but did not excuse you from missing the day or been tardy. The associates are only allowed 3 abcences on a 6 months period. After 3 abcences the associate start getting coech for every abcence. Believe me, is not funny and I wish Wal-Mart will become Union.

Wal-marts sick day policy is just as bad as their “D” day policy. I work there so I have no one to blame but myself. But how does all this make sense?
The funny part is as an employee you have to watch CBL’s which are training programs on a computer. The other day while watching one for the food side it go’s over symptoms for stuff like cold or flu and tells you that you should not go to work with these symptoms, makes sense because you are handling food.
If you miss one day it will count against you let’s call it a “ding” if you will. If you miss 3 days consecutively it still counts as one “ding”. Oh yea I can’t for get to say you don’t get paid for the first day but can use sick pay for the other 2 days. You no longer need doctors’ note to miss but after 3 to 4 “dings” it’s a verbal warning and by the time you hit 6 you are fired. To be fair this is on a 6 month rolling schedule so after 6 months from your “ding” it will drop off.

Talk about mixed messages!
Ok so here we go!
If I have the flu I should go to work so I don’t get a “ding” but I shouldn’t go to work because I may get others sick.
If I take off the one day to try and get better I’m getting a “ding” I don’t get paid for it, so if I’m getting a “ding” I might as well take a total of 3 days off so I at least get sick pay for 2 of the days and 3 days sick in a row still only count as one “ding” (sick pay is something I did earn and if you leave you can’t take it with you)

You would think that one of the largest companies in the world would come up with something better. Go ahead ask me about the “D” day policy it’s just as crazy.

Question from a fellow 15 yr associate of Wal Mart. If you stay home because your child is very sick and in need of a doctors evaluation, then is diagnosed and written a prescription for the illness and you are both given an excuse for school and for work, Is that an excused abscence through fmla ???? please respond, an abused associate of store #0376

Posted by DANIELLE - April 16, 2008 10:59 PM

From my understanding it is, but where I'm at you would still have it counted against you, but would be able to keep you job if you needed to miss more then the 3 days.
Remember even an excused absences still is counted against you.

Why would it be allowed through walmart for an associate to go out on medical leave sick and then for a member of management to call them and harass them about what is going on in the work area. Can You not take time off from work without being harassed? What can be done about being called at home and being verbally abused over the phone by management?

What happens if you had an emergency and you forgot to call the 1800 number to report your absence before your scheduled shift was to start?

Posted by AJ - May 16, 2008 11:24 PM

I just called in sick for today because I'm actually feeling ill and I'm already being requested a doctors note. I'm rather insulted considering I always take peoples shifts and I'm always staying late when I'm asked to. Not everyone goes to see the doctor right away when they're ill. I don't think it's fair to request a note unless there's some sort of pattern appearing in my attendance .

I'm 5 months pregnant the doctor wrote me a note stating no heavy lifting, beings i work in the bakery, they called me into the office and said you have to take your fmla with no pay until the dr says you can come back to work, and they also stated that there is no place me in this club Sams club get your things and get out. You tell me what is right about this. I have never been fired or layed off from a job, where is the justice in this, I truly beleive it all depends on who you are in walmart stores or sams club stores to get what you want. Working in the bakery you have to pick up 20 plus pounds, but they don't care that you need money to survive, I just wish that they could be in the other peoples shoes and too see how it feels, Alot of the things that goes on in a club has to do with the store manager, if they do not approve then you are out the door, but they need to remember they can be knocked down a peg or to, beings that they have God complexes.

I work for Walmart or I think I do. I am on leave right now and the communication between managers sucks.
As an employee we get talked to like dogs. Every rule the company developes is to get the associates to work harder and be under paid. The new plan the customer must win is a joke. It was developed to get its department managers and other asscoiates to do more work so, they have to do less hiring. The government needs to get involved and break up this company and start watching Walmart alot closer. They brain wash there asscoiates. I heard my market manager say your not pro-Walmart if you don't bleed blue blood. Whats that tell ya.....

I am on a LOA from my dr. for Epilepsy I have been hearing rumors from other employees that I'm fixing to get fired when I return and that the management should have already fired me before my big boss had left.

k, so i started aquiring symptoms of strep, which has been knowingly been going around in my family. i went in yesterday when i started getting the sore throat and one associate suggested i stay in for 4 hours before i talk to management because that would only give me a tardy instead of an absence. after 4 hours i told the manager and he just waved his hand when i told him that i might have something contagious. i call in today for an absence using the 800 number. i have tomorrow off. i am going to try and see if i really have strep. my question is: do i need a medical report saying i had strep? do they even ask?

i recently wound up in the hospital... i had called out on a monay and had tues and weds off but thursday ended up in the hospital and had to call in again. i called walmart later that night to ask if it was going to effect my job at all and the manager told me that i was going to get written up for not coming ot work. i called the 800 number and gave the conf. #'s for both days... he told me if i didnt come back to work the next day that i would be coached. my dr. told me i needed to stay home till i was fully recovered. but because of what the manager had said i went to work the next day anyway. that was 2 weeks ago and i am still not fully recovered. i was just wondering if what the manager said was true or if anything can be done to have the marks removed?

Could someone please explain the absence policy to me. I understand about 3 consecutive days equal one absence, 7 days in 6 months and you can get fired ( at the store I work for, extreme displays of favoritism come into play with that one). What are the steps required by management as to coachings and d-days before firing? Is it one verbal, one written, one d-day and then you're fired? And, do the coachings and d-day roll over after 6 months or a year or do they just keep counting endlessly until you're axed? And yes, I do truly believe that Walmart is trying to "weed out" the full timers and long timers in favor of a newer, cheaper, part time crew....I just don't think they realize that the quality of employees will not be what it once was. I don''t think they care about anything but profit, though.
